BOOVS ACCEPTANCE AND LIABILITY AGREEMENT

This Acceptance and Liability Agreement (“Agreement”) is made between Dixjuin Digital Agency & Software Solutions Inc. (hereinafter referred to as “Boovs”) and users who access and utilize the digital platform provided by Boovs (boovs.com) (hereinafter referred to as the “User”). All transactions conducted through Boovs.com are subject to this Agreement.

1. Parties and Definitions

Hereinafter referred to as "Boovs" within this Agreement.

User:

Any individual or legal entity who accesses Boovs’ digital platform (boovs.com), utilizes its services, and agrees to this Agreement.

Website:

Refers to Boovs’ digital platform at boovs.com. All services, information, and content provided through the website are subject to this Agreement.

2. Purpose and Scope

This Agreement clarifies that Boovs solely acts as an intermediary between healthcare providers and users, is not responsible for the delivery of medical services, and that users accept all risks associated with their medical treatment processes. The Agreement outlines the limits of services provided by Boovs and specifies Boovs' liabilities.

3. Boovs’ Liability Disclaimer

Intermediary Role:

Boovs provides only intermediary and consultancy services and is not responsible for any direct medical treatment, surgery, diagnosis, or the provision of any healthcare service.

Independence of Medical Service Providers:

Boovs acts solely as an intermediary and the healthcare providers operate independently, not as employees, agents, or partners of Boovs. The healthcare providers are fully responsible for the services they provide.

Medical Decisions:

Medical decisions and treatment processes are determined and executed directly by healthcare providers. Boovs declares that it has no influence over these processes and provides no guarantees regarding medical outcomes.

Outcomes and Complications:

Boovs is not liable for treatment outcomes, complications, unexpected side effects, or other issues related to the treatment. Users acknowledge that they are aware of all risks associated with their treatment and accept these risks.

Third-Party Liability:

Boovs cannot be held responsible for any disputes, service errors, or complications arising between users and healthcare providers. The user agrees that healthcare providers are directly responsible and that all claims must be directed to these providers.

4. User Responsibilities

Acceptance of Risks:

The user declares that they understand and accept the risks associated with their treatment, including but not limited to surgical complications, potential issues during the recovery process, and other medical uncertainties.

Awareness of Personal Health Status:

The user is responsible for being aware of their own health status and for providing complete and accurate information to the healthcare provider before commencing treatment. Boovs accepts no liability for any consequences arising from incorrect or incomplete information provided by the user.

Compliance with Healthcare Provider Instructions:

The user agrees to comply with all instructions and recommendations given by the healthcare provider. This includes adherence to pre- and post-operative guidelines and other treatment-related protocols.

5. Waiver of Claims for Compensation

Compensation and Refund Claims:

The user agrees not to claim compensation or refunds from Boovs in the event of dissatisfaction with surgery or treatment outcomes. All claims should be directed to the healthcare provider directly.

No Compensation Liability for Boovs:

As Boovs solely provides intermediary services, it accepts no direct or indirect financial liability for any claims made by the user. The user acknowledges that any legal or financial claims against Boovs are invalid.

6. Legal Disputes and Jurisdiction

Resolution of Disputes:

Any disputes arising from this Agreement are subject to the laws of the Republic of Turkey, and the courts and execution offices of Kayseri shall have jurisdiction.

Jurisdiction Statement:

The user agrees to accept this jurisdiction before initiating any legal action against Boovs and undertakes not to apply to any other jurisdiction. The user understands that Boovs will not accept any claims made outside its jurisdiction.

Legal Actions in Foreign Countries:

The user agrees not to initiate any legal proceedings against Boovs outside Turkey, and even if such actions are initiated, they acknowledge that these actions will not be legally valid.

7. Duration and Termination of the Agreement

Validity Period:

This Agreement takes effect on the date it is approved by the user and remains in force until terminated by either party. The user may terminate the Agreement by closing their account on Boovs.com or by providing written notice to Boovs.

Liabilities in Case of Termination:

Upon termination, the responsibilities assumed by the user and Boovs’ liability disclaimer shall continue to remain in effect.

8. Force Majeure

Liability in Force Majeure:

Boovs accepts no liability for service disruptions caused by force majeure events such as natural disasters, war, pandemics, government interventions, internet or communication outages.

9. Changes to the Agreement

Right to Amend:

Boovs reserves the right to amend this Agreement. Changes will be announced on Boovs.com and submitted for user approval. Users are deemed to have accepted the changes if they do not object within the specified period.

10. Definition and Limitations of Boovs’ Services

Service Limitations:

Boovs provides only information, consultancy, and coordination services between healthcare providers and users. These services do not include medical interventions, and Boovs bears no responsibility in these areas.

11. Data Protection and Privacy

Privacy Policy:

Users can access detailed information on how Boovs handles personal and health data in the Privacy Policy. User data will not be shared with third parties without permission, and necessary legal protections will be provided.

12. Payment and Refund Processes

Financial Responsibilities:

Boovs is only responsible for coordinating payment and refund processes, with all financial responsibilities resting directly with the healthcare providers. Users should direct all related claims directly to the healthcare provider.
